SPIBA Committee on Legislation and Lobbying has sent a letter to the Office of the Federal Tax Service in St. Petersburg on behalf of the Association.

A letter was sent in connection with the fact that since November 2011 Russian Federal Tax Service Inspection of St. Petersburg refused to register the establishment and state registration of changes to the information or the constituent documents of legal entities, which includes the companies registered in Cyprus, or Cypriot citizens.

In particular, the Inspectorate requires the signature of the applicant - citizen of a foreign country (Cyprus) on the statements in the prescribed form (R11001, R13001, R14001, and others) on a mandatory basis notarized in Russia or consular officer in a foreign country. Meanwhile, this requirement contradicts to the ratified international conventions and treaties between Russia and Cyprus. In addition, consular perform notarial acts only to citizens of Russia and Russian companies. It turns out to the situation, when the Cypriot companies and nationals of Cyprus who are members of Russian legal entities are not able to verify in Cyprus authenticity of their signatures on the statements of the Russian tax authorities. To do this they must travel to St. Petersburg and to certify the signature in russian notary office.

It should be noted that these requirements currently exist only in St. Petersburg. Tax authorities in other regions continue to receive the registration statement, signed by the foreign participants are certified by a notary in foreign countries, and the legitimacy of which is certified by Apostille with the application of the Russian translation, certified by russian notary.
